Service Guarantee Overview

MetLife Defender takes a proactive approach to protecting your personal information, continuously searching for vulnerable data and working to resolve those threats before they become a problem for you. However, it’s not possible to stop every single incident of identity theft or fraud, even with our innovative approach and technology. So if you, as a customer who meets the eligibility requirements, should experience an unauthorized use of your personal information, MetLife Defender will spend up to $5 million to help restore and recoup damages.

• Pay up to $5,000,000 to third-party professionals to provide services
• Provides for services deemed necessary to recover your out-of-pocket costs resulting from the fraudulent activity
• Services provided include experts, attorneys, investigators, consultants and/or other service providers that are needed to assist your recovery.

Eligibility

The MetLife Defender services are provided by Tiversa Holding Corp. and its subcontractors (“Tiversa”) by agreement with MetLife and are backed by Tiversa’s $5,000,000 Service Guarantee. To be eligible for the Service Guarantee, you must (a) be a member who has agreed to be bound by the general terms and conditions set forth in the MetLife Defender End User Agreement (“Member Agreement”), (b) be in compliance with the terms and conditions of the Member Agreement, (c) have paid all amounts due for the service, and (d) have performed or complied with each of the obligations in this Service Guarantee.

Benefits

Although stopping all forms of identity theft and fraud may not be possible, Tiversa takes continuous and proactive measures to reduce your risk and vulnerabilities before you become a victim. The service continuously scans for threats online and monitors national and global networks for your personally identifiable information. Tiversa searches for unwanted disclosures and works to resolve any and all known threats before they become a problem. If there is a problem, resolution experts work closely with you to evaluate your specific situation and provide the support you need to remediate the problem quickly.

If the conditions described above under the heading Eligibility are met and you become a victim of fraudulent activity involving unauthorized use of your personal information resulting from a failure of or defect in the services, Tiversa will pay up to a maximum of $5,000,000 to third-party professional service providers retained by Tiversa for professional services that it deems to be reasonably necessary for the purpose of recovering your out-of-pocket losses directly resulting from such fraudulent activity, subject to your performance of the obligations described below under the heading Your Obligations. This includes engaging experts, attorneys, investigators, consultants and/or other service providers as necessary to help your recovery.

Your Obligations

You shall notify MetLife within fifteen (15) days of the date that you become aware of fraudulent activity and cooperate fully with Tiversa and any third-parties retained by Tiversa to assist you by, without limitation, responding promptly and truthfully to requests for information, executing any documents that you are reasonably requested to execute and providing copies of any investigative reports relating to the incident prepared by banks, law enforcement agencies or other institutions. If any bank, law enforcement agency or other institution determines after reasonable investigation that your loss is not due to identity theft, this Service Guarantee shall not apply. You shall also protect your personal information, including, but not limited to, your Social Security number, personal health and medical information, credit card information, personal security information including user login, passwords and PIN numbers, at all times using no less than a reasonable standard of care. You shall not negligently or recklessly disclose or publish your personal information. Upon notification from MetLife or Tiversa you shall immediately remove from your computer any malicious code or software or peer-to-peer sharing software. If you fail to perform or comply with these obligations, you will not be covered by this Service Guarantee.

Exclusions and Limitations

Tiversa will not make payments to you directly for losses or liabilities that you incur in connection with any fraudulent activity, including, but not limited to, fraudulent withdrawals or purchases from banking or credit accounts. Tiversa will not pay expenses associated with any service providers not retained directly by Tiversa. This Service Guarantee does not cover fraudulent activity resulting from any disclosure or theft of personal information that occurs before you agree to the terms and conditions of the Member Agreement, even if the fraudulent activity continues thereafter, or any theft of personal information that is discovered after you are no longer a member. MetLife or Tiversa will require you to provide documentation that allows Tiversa to verify when a disclosure or theft of personal information actually occurred, and Tiversa’s determination as to your qualification for this Service Guarantee shall be binding. If you misrepresent any information to MetLife or Tiversa including, but not limited to, any information required to become a member or information relating to the timing or occurrence of fraudulent activity, Tiversa shall be entitled to recover all amounts paid on your behalf.

This Service Guarantee covers only members meeting the criteria set forth herein. It does not cover any business entity.

In no event will the amount paid by Tiversa to service providers retained by Tiversa exceed $5,000,000. THIS SERVICE GUARANTEE STATES TIVERSA’S ENTIRE LIABILITY AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY FAILURE OF OR DEFECT IN THE SERVICES PROVIDED. IN NO EVENT SHALL TIVERSA BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, lost income due to time away from work, damage to your reputation or losses resulting from any decrease in your credit rating.
